The Justice Department released nine legal opinions showing that, following the Sept. 11, 2001, terrorist attacks, the Bush administration determined that certain constitutional rights would not apply during the coming fight. Within two weeks, government lawyers were already discussing ways to wiretap U.S. conversations without warrants.
The Bush administration eventually abandoned many of the legal conclusions, but the documents themselves had been closely held. By releasing them, President Barack Obama continued a house-cleaning of the previous administration's most contentious policies.
"Too often over the past decade, the fight against terrorism has been viewed as a zero-sum battle with our civil liberties," Attorney General Eric Holder said in a speech a few hours before the documents were released. "Not only is that school of thought misguided, I fear that in actuality it does more harm than good."
The Obama administration also acknowledged in court documents Monday that the CIA destroyed 92 videos of involving terror suspects, including interrogations — far more than had been known. Congressional Democrats and other critics have charged that some of the harsh interrogation techniques amounted to torture, a contention President George W. Bush and other Bush officials rejected.
The new administration pledged on Monday to begin turning over documents related to the videos to a federal judge and to make as much information public as possible.
The legal memos written by the Bush administration's Office of Legal Counsel show a government grappling with how to wage war on terrorism in a fast-changing world. The conclusion, reiterated in page after page of documents, was that the president had broad authority to set aside constitutional rights.
Fourth Amendment protections against unwarranted search and seizure, for instance, did not apply in the United States as long as the president was combatting terrorism, the Justice Department said in an Oct. 23, 2001, memo.
"First Amendment speech and press rights may also be subordinated to the overriding need to wage war successfully," Deputy Assistant Attorney General John Yoo wrote, adding later: "The current campaign against terrorism may require even broader exercises of federal power domestically."
On Sept. 25, 2001, Yoo discussed possible changes to the laws governing wiretaps for intelligence gathering. In that memo, he said the government's interest in keeping the nation safe following the terrorist attacks might justify warrantless searches.
That memo did not specifically attempt to justify the government's warrantless wiretapping program, but it provided part of the foundation.
Yoo, now a professor at the University of California at Berkeley School of Law, did not return messages seeking comment.
The memos reflected a belief within the Bush administration that the president had broad powers that could not be checked by Congress or the courts. That stance, in one form or another, became the foundation for many polices: holding detainees at Guantanamo Bay, eavesdropping on U.S. citizens without warrants, using tough new CIA interrogation tactics and locking U.S. citizens in military brigs without charges.
Obama has pledged to close the Guantanamo Bay prison within a year. He halted the CIA's intensive interrogation program. And last week, prosecutors moved the terrorism case against U.S. resident Ali Al-Marri, a suspected al-Qaida sleeper agent held in a military brig, to a civilian courthouse.
A criminal prosecutor is wrapping up his own investigation of CIA interrogations.
Monday's acknowledgment of videotape destruction, however, involved a civil lawsuit filed in New York by the American Civil Liberties Union.
"The CIA can now identify the number of videotapes that were destroyed," said the letter submitted in that case by Acting U.S. Attorney Lev Dassin. "Ninety-two videotapes were destroyed."
It is not clear what exactly was on the recordings. The government's letter cites interrogation videos, but the lawsuit against the Defense Department also seeks records related to treatment of detainees, any deaths of detainees and the CIA's sending of suspects overseas, known as "extraordinary rendition."
At the White House, press secretary Robert Gibbs told reporters he hadn't spoken to the president about the report, but he called the news about the videotapes "sad" and said Obama was committed to ending torture while also protecting American values.

Did Ancient Viruses Spur Human Evolution?[/size][/b] www.dailygalaxy.com/my_weblog/2009/03/did-ancient-vir.html2009-03-03 When the mapping of the human genome was completed in 2003, researchers discovered a shocking fact: our bodies are littered with the shards of retroviruses, fragments of the chemical code from which all genetic material is made. This discovery has created a new discipline, paleovirology, which seeks to better understand the impact of modern diseases by studying the genetic history of ancient viruses.
Highly infectious viral diseases -including the Plague, yellow fever, measles, smallpox and he Spanish Flu, which killed 50 million people at the end of the First World War, moving from one cell to the next, transforming each new host into a factory that makes even more virus. In this way, one infected cell soon becomes billion -that die when the host dies.
Endogenous retroviruses, however, once they infect the DNA of a species they become part of that species: they reside within each of us, carrying a record that goes back millions of years. Molecular battles of endogenous retroviruses that raged for thousands of generations, have been defeated by evolution.
These viral fragments are fossils that reside within each of us, carrying a record that goes back millions of years. Because they no longer seem to serve a purpose or cause harm, these remnants have often been referred to as “junk DNA.” Although many of these evolutionary relics still manage to generate proteins, scientists have never found one that functions properly in humans or that could make us sick.
That is until Thierry Heidmann who runs the laboratory at the Institut Gustave Roussy, on the southern edge of Paris, brought one to life. Heidmann long suspected that if a retrovirus happens to infect a human sperm cell or egg, which is rare, and if that embryo survives—which is rarer still—the retrovirus could have the evolutionary power to influence humans as a species becoming part of the genetic blueprint, passed from mother to child, and from one generation to the next, much like a gene for eye color or asthma.
In a brilliant essay if The New Yorker, author Michael Specter brought Heidmann's discovery to life, showing how by "combining the tools of genomics, virology, and evolutionary biology, he and his colleagues took a virus that had been extinct for hundreds of thousands of years, figured out how the broken parts were originally aligned, and then pieced them together. After resurrecting the virus, the team placed it in human cells and found that their creation did indeed insert itself into the DNA of those cells. They also mixed the virus with cells taken from hamsters and cats. It quickly infected them all, offering the first evidence that the broken parts could once again be made infectious. The experiment could provide vital clues about how viruses like H.I.V. work. Inevitably, though, it also conjures images of Frankenstein’s monster and Jurassic Park."
Heidmann named the virus Phoenix, after the mythical bird that rises from the ashes, because he is convinced that this virus and others like it have much to tell about the origins and the evolution of humanity.
“This is something not to fear but to celebrate,’’ Heidmann told Specter one day as they sat in his office at the institute, which is dedicated to the treatment and eradication of cancer.“What is remarkable here, and unique, is the fact that endogenous retroviruses are two things at once: genes and viruses. And those viruses helped make us who we are today just as surely as other genes did. I am not certain that we would have survived as a species without them. The Phoenix virus sheds light on how H.I.V. operates, but, more than that, on how we operate, and how we evolved. Many people study other aspects of human evolution—how we came to walk, or the meaning of domesticated animals. But I would argue that equally important is the role of pathogens in shaping the way we are today. Look, for instance, at the process of pregnancy and birth.’’
Heidmann believes that without endogenous retroviruses mammals might never have developed a placenta, which protects the fetus and gives it time to mature, which eventually led to live birth, one of the hallmarks of human evolutionary success over birds, reptiles, and fish. Eggs cannot eliminate waste or draw the maternal nutrients required to develop the large brains that have made mammals so versatile. “These viruses made those changes possible. It is quite possible that, without them, human beings would still be laying eggs.”

The discovery increases the chances of life existing on the planet in the recent past, or even surviving today.
Scientists identified the gullies inside a crater that appear to be not more than 1.25 million years old.
They believe the channels must have been sculpted by surface water from melting ice.
There is evidence of water-borne sediments being carried down from high ground and deposited in low-lying alluvial fans.
Professor James Head, from Brown University in Rhode Island, USA, who with colleagues reported on the discovery in the journal Geology, said: "We think there was recent water on Mars. This is a big step in the direction to proving that."
The gully system is in Promethal Terra, an area of cratered highlands south of the Martian equator.
A powerful camera on the American space agency Nasa's Mars Reconnaissance Orbiter spacecraft was able to distinguish four individual lobes of deposited material in the fan system.
One was pockmarked with small craters linked to another crater 80 kilometres away known to be 1.25m years old.
This lobe was likely to be about the same age. The other three lobes were unblemished and therefore had to be younger, said the scientists.
They believe the best explanation for the gullies is melting snow and ice rather than groundwater bubbling up to the surface.
The finding follows discoveries of water-bearing minerals such as opals and carbonates on Mars.
Experts now think the planet was occasionally wet for far longer than was previously believed.

Research published in the US scientific journal Copeia says the fish was spotted by scuba divers off the island of Ambon in eastern Indonesia.
It belongs to the frogfish family, but its looks are unique even among its peers, the journal reported.
The question with this new discovery is how it went unnoticed for so long.
The new psychedelica frogfish is completely covered in swirling concentric stripes - white and blue on a peach background - radiating out from its aqua-coloured eyes.
It has a broad flat face, thick fleshy cheeks and chin, and eyes that look forward like a human's.
The fish was spotted by divers off the coast of Ambon island last year.
The divers described it moving away from them in a series of short hops, its pelvic fins pushing it off the sea bed with each bounce.
"The overall impression" says the Copeia research paper, was of "an inflated rubber ball bouncing along the bottom".
The species was first discovered almost 20 years ago, but sat on a shelf - wrongly labelled and gathering dust - until this most recent find.
It came to light when the divers were unable to identify the fish from photographs circulated among their colleagues, and sent pictures to a frogfish expert at the University of Washington.

I wanted to take a moment to explain to the public EXACTLY what is going on, and why we have undergone a temporary closure of the Eagles Forum and Think Tank.
Reports that there was a somewhat recent attempt to steal the design of the Lotus Viewing Unit (the so called "Widget") are TRUE. We have put a stop to that, and it wasn't anything of a serious nature. (We keep certain things unknown to almost everyone.)

Where have we gone? I am right here! ;D
Many are wondering what the so called "W*r for Everything" is all about? Some wonder why we're so deadly serious about it? While I will not come right out and say it in front of the public at the moment, due to serious security concerns...many members of the Eagles Forum and some other folks KNOW EXACTLY what's going on! (We allowed them to know.)
The "W*r for Everything" has been, as of the end of today, going on EVERY DAY for 17 years, 8 months, and 15 days! That's a long time, huh? Yes, it is a long time!
What could it be? Those with an intimate knowledge of the history of Marcia and myself, our lives, efforts, have already figured it out. Others, mostly the loudest ones about everything they allegedly know about me: they ramble about and act like they have no clue! ;D Notice? It gives them away.
The "W*r for Everything" has NOTHING to do with the state of the world, or the timelines - NOTHING! So, if anyone was worried about that, they can relax. We diverted away from Timeline 2 (the catastrophic one), and we are now seemingly well away from the timeline where the greatest probability existed: Timeline 1 Variant 83. We are now on a path without precedent. That's makes some afraid, they will remain nameless, but everyone can hear it in their voices as they grab a hold onto every fear producing news clip they can find! Not us! We believe in ourselves, each other, and YOU, and are not afraid of a hobgoblin who might jump out and say, "Boo!" ;D Thanks the same, but we're adults! ;D We'll face the crises, we know they're there, but we will not incessantly whine like babies about them or grab fear like it be some "night night bottle" Mama would give us before being tucked in: we're adults, we have jobs to do, so we'll do the jobs! It will and does take work, especially to bring us (collectively as a world) out of what we've got ourselves into, but we're men and women enough to do it! (Got ourselves into? Yes. We...the adults of this world ARE RESPONSIBLE FOR IT. THAT'S PART OF THE DEFINITION OF BEING AN "ADULT" - RESPONSIBILITY.) That's the difference you know: WE HAVE FAITH IN OURSELVES, SO WE HAVE NO PROBLEM SHOWING UNWAVERING FAITH IN EVERYONE ELSE! Me? Well...just speaking for me...I AM AN AMERICAN! THAT MEANS SOMETHING TO ME! I don't engage in fear, that has just got to be someone else's malady.
No, the "W*r for Everything" is intensely personal, and has to do with FREEDOM! I swore into Majestic, and take the responsibility for it, but there have been some things which I have not "sworn into"...that's where the "W*r for Everything" resides...there and basic human rights! WE ARE ENFORCING THEM NOW. The "W*r for Everything" WILL BE WON. It's just that simple...and the public who now not knows of what I speak...will.
About the Eagles Forum's Moderator and this forum's Administrator...
Nodstar* is the ONE PERSON, outside of our little former Majestic circle, a person from the public, who KNOWS EVERYTHING about what's going on: "The W*r for Everything," "Project Isis," the whole lot. She knows what's on the horizon...so in the parlance of our former Majestic, "She can see for miles and miles!" (That song was an Operational Theme Song within Majestic.) We decided to place our complete trust in one person's hands - hers. That decision was the right one! I can't wait...almost giggling as I write...for the conspiracy theorists...the ones who see more conspiracies than theories?... ;D ...they'll label her a Majic operative next. ;D She's just "good people" and that radiates beyond the dark morass! The fact that we asked her, and confided in her, will be confusing to some...probably the concept of "good people"...as they will find it necessary to place a label, rather than looking in a mirror at themselves. Oh, well.
So...the Think Tank? It's closed for awhile. The focus on what's important, first, will continue.
Well...now that things have moved closer...my attentions will largely go there (the "W*r for Everything")...while we continue at a slow pace readying for this week's Widget Systems Test. It will still "go off" as scheduled, and so will the first Webcast.
Nothing has been stopped.
The Team is undergoing a security contraction around us, due to the phase we're in, and so they don't have the time to do a 24/7 ITS security watch over the Eagles Forum...hence its temporary closure. We had a personnel choice: our security watch over

For Nodstar*, (and yes, the public), YES. Marcia is too busy, given the "W*r for Everything," to be responding to many questions via her public email, and Fran's (Caspa's) and Frank's (Squirrel's) abilities are now being put to other measures, FULL TIME, involving another project.
When it's time for Fran to have the baby, or when she says it's time to "stop" for awhile, Brian (Owl) will be cross assigned, along with his webmaster duties for Eagles Disobey, to assisting Frank.

This is THE reason why we receive constant attacks for only marketing our products where we are - out of Eagles. Some don't like the needy benefitting. Too bad. We may, in the future, decide to spread the marketing a bit...but...that will be our decision...then.
ANGEL EAGLES and Eagles Disobey will continue forward, no matter what. As for the possible future marketing...we've TURNED DOWN about 4 offers so far...we'll see...AND IT WILL BE US (MARCIA AND MYSELF) WHO MAKE THE DECISION.

Leaders and commanders of warring nations regularly underestimate the costs in time, money, and human lives required for bringing home a victory. CEOs of Fortune 500 companies routinely overestimate their capacity to turn mergers and acquisitions into huge profits, leading to financial losses for themselves, their companies, and their stockholders. Even ordinary people seem to take on an air of invincibility after being promoted to a more powerful position. The consequences of these tendencies, especially when present in the world's most powerful leaders, can be devastating. In a new study, Nathanael Fast and Deborah Gruenfeld at Stanford Graduate School of Business, Niro Sivanathan at the London Business School and Adam Galinsky at the Kellogg School of Management at Northwestern University, show that power can literally "go to one's head," causing individuals to think they have more personal control over outcomes than they, in fact, do. "We conducted four experiments exploring the relationship between power and illusory control - the belief that one has the ability to influence outcomes that are largely determined by chance," said Galinksy, "In each experiment, whether the participant recalled power by an experience of holding power or it was manipulated by randomly assigning participants to Manager-Subordinate roles, it led to perceived control over outcomes that were beyond the reach of the individual. Furthermore, the notion of being able to control a 'chance' result led to unrealistic optimism and inflated self-esteem." For example, in one experiment, power holders were presented with a pair of dice, offered a reward for predicting the outcome of a roll, and then asked if they would like to roll the dice or have someone else do it for them. Each and every participant in the high power group chose to roll the dice themselves compared to less than 70% of low power and neutral participants, supporting the notion that simply experiencing power can lead an individual to grossly overestimate their abilities, in this case, influencing the outcome of the roll by personally rolling the dice. These results, reported in Psychological Science, a journal of the Association for Psychological Science, have implications for how power, once attained, is maintained or lost. The authors note that positive illusions can be adaptive, helping power holders make the seemingly impossible possible. But the relationship between power and illusory control might also contribute directly to losses in power, by causing leaders to make poor choices. They conclude that "the illusion of personal control might be one of the ways in which power often leads to its own demise."
