FBI broke law for years in phone record searches[/size] Washington Post www.washingtonpost.com/wp-dyn/content/article/2010/01/18/AR2010011803982.html2010-01-20 The FBI illegally collected more than 2,000 U.S. telephone call records between 2002 and 2006 by invoking terrorism emergencies that did not exist or simply persuading phone companies to provide records, according to internal bureau memos and interviews. FBI officials issued approvals after the fact to justify their actions. E-mails obtained by The Washington Post detail how counterterrorism officials inside FBI headquarters did not follow their own procedures that were put in place to protect civil liberties. The stream of urgent requests for phone records also overwhelmed the FBI communications analysis unit with work that ultimately was not connected to imminent threats. A Justice Department inspector general's report due out this month is expected to conclude that the FBI frequently violated the law with its emergency requests, bureau officials confirmed. The records seen by The Post do not reveal the identities of the people whose phone call records were gathered, but FBI officials said they thought that nearly all of the requests involved terrorism investigations. FBI general counsel Valerie Caproni said in an interview Monday that the FBI technically violated the Electronic Communications Privacy Act when agents invoked nonexistent emergencies to collect records. "We should have stopped those requests from being made that way," she said. The after-the-fact approvals were a "good-hearted but not well-thought-out" solution to put phone carriers at ease, she said. In true emergencies, Caproni said, agents always had the legal right to get phone records, and lawyers have now concluded there was no need for the after-the-fact approval process. "What this turned out to be was a self-inflicted wound," she said. Caproni said FBI Director Robert S. Mueller III did not know about the problems until late 2006 or early 2007, after the inspector general's probe began. Documents show that senior FBI managers up to the assistant director level approved the procedures for emergency requests of phone records and that headquarters officials often made the requests, which persisted for two years after bureau lawyers raised concerns and an FBI official began pressing for changes. "We have to make sure we are not taking advantage of this system, and that we are following the letter of the law without jeopardizing national security," FBI lawyer Patrice Kopistansky wrote in one of a series of early 2005 e-mails asking superiors to address the problem. The FBI acknowledged in 2007 that one unit in the agency had improperly gathered some phone records, and a Justice Department audit at the time cited 22 inappropriate requests to phone companies for searches and hundreds of questionable requests. But the latest revelations show that the improper requests were much more numerous under the procedures approved by the top level of the FBI. FBI officials told The Post that their own review has found that about half of the 4,400 toll records collected in emergency situations or with after-the-fact approvals were done in technical violation of the law. The searches involved only records of calls and not the content of the calls. In some cases, agents broadened their searches to gather numbers two and three degrees of separation from the original request, documents show. Bureau officials said agents were working quickly under the stress of trying to thwart the next terrorist attack and were not violating the law deliberately. FBI officials said they are confident that the safeguards enacted in 2007 have ended the problems. Caproni said the bureau will use the inspector general's findings to determine whether discipline is warranted. The internal memos were obtained from a government employee outside the FBI, who gained access to them during the investigations of the searches. The employee spoke on the condition of anonymity because the release was unauthorized. After the Sept. 11, 2001, attacks, the need to get information quickly and connect the dots was considered paramount throughout the federal government. The failure to obtain timely and actionable information has been a recurrent theme in the U.S. counterterrorism effort, up to and including the recent shootings at Fort Hood, Tex. Before 9/11, FBI agents ordinarily gathered records of phone calls through the use of grand jury subpoenas or through an instrument know as a national security letter, issued for terrorism and espionage cases. Such letters, signed by senior headquarters officials, carry the weight of subpoenas with the firms that receive them. The USA Patriot Act expanded the use of national security letters by letting lower-level officials outside Washington approve them and allowing them in wider circumstances. But the letters still required the FBI to link a request to an open terrorism case before records could be sought. Shortly after the Patriot Act was passed in October 2001, FBI senior managers devised their own system for gathering records in terrorism emergencies. A new device called an "exigent circumstances letter" was authorized. It allowed a supervisor to declare an emergency and get the records, then issue a national security letter after the fact. The procedure was based on a system used in the FBI's New York office in the days immediately after the Sept. 11 suicide hijackings, officials said. On Jan. 6, 2003, then-FBI Assistant Director for Counterterrorism Larry Mefford issued a bureau-wide communique authorizing the new tactic, saying the bureau's telephone analysis unit was permitted in "exigent circumstances . . . to obtain specialized toll records information for international and domestic numbers which are linked to subjects of pending terrorism investigations." The e-mail called this new method of gathering phone records "imperative to the continuing efforts by the FBI to protect our nation against future attacks," even as it acknowledged the phone records of many people not connected to a terrorism investigation were likely to be scooped up. The 2003 memo stated that the new method "has the potential of generating an enormous amount of data in short order, much of which may not actually be related to the terrorism activity under investigation." Within a few years, hundreds of emergency requests were completed and a few thousand phone records gathered. But many lacked the follow-up: the required national security letters. Special Agent Bassem Youssef, the new supervisor of the communications analysis unit that gathered the records, began to receive complaints from phone companies that they had not received documentation to show the searches were legal. Youssef, a longtime counterterrorism investigator, had earlier fallen out of favor with FBI management as he pursued a whistleblower claim that he had been wrongly retaliated against and denied promotion because of his ethnicity. He raised questions in spring 2005 with his superiors and the FBI general counsel's office about the failure to get national security letters. E-mails show he pressed FBI managers, trying to "force their hand" to implement a solution. Youssef's attorney, Stephen Kohn, said Monday that he could not discuss the specifics of the investigation except to confirm that his client cooperated with the inspector general. FBI officials said they could not discuss the conduct of individual employees. Separately, Kopistansky in the FBI general counsel's office learned in mid-December 2004 that toll records were being requested without national security letters. She handled a request that originated from then-Executive Assistant Director Gary Bald, who had "passed information regarding numbers related to a terrorist organization with ties to the US" and obtained toll records, the memos show. The communications analysis unit asked Kopistansky to "draw up an NSL" to cover the search, but she was unable to get superiors to tell her which open terrorism case it involved. The request "has to specify why the numbers are relevant to an authorized investigation," she said. An employee in the communications analysis unit wrote back that most of the emergency requests he received "come from upper mgmt. I don't always receive documentation or know all the facts related to the number, which is a problem for me when I try to get the NSL." Kopistansky persisted, demanding an open terrorism case file for the legal rationale. "I am sure you know it is true and Gary Bald knows it's true, but it needs to be reflected on a piece of paper," she wrote. Two months later, Kopistansky was still unable to issue a national security letter to comply with the FBI rules. She took note of the overall problem. The issuance of a national security letter after exigent searches "rarely happens," Kopistansky warned in a March 11, 2005, e-mail seeking the help of the FBI's top national security lawyer and the deputy counsel. By March 2005, Kopistansky and Youssef were discussing a worsening "backlog" of other cases where no national security letters had been issued and growing concerned that exigent letters were being abused, e-mails show. "I also understand that some of these are being done as emergencies when they aren't necessarily emergencies," Kopistansky wrote in an April 26, 2005, e-mail to Youssef. Kopistansky and the other FBI lawyers discussed a strategy to handle the past emergency searches and to allow the practice to continue. The e-mails show that they conceived the idea to open half a dozen "generic" or "broad" preliminary investigative (PI) case files to which all unauthorized emergency requests could be charged so a national security letter could be issued after the fact. The generic files were to cover such broad topics as "threats against transportation facilities," "threats against individuals" and "threats against special events," the e-mails show. Eventually, FBI officials shifted to a second strategy of crafting a "blanket" national security letter to authorize all past searches that had not been covered by open cases. A November 2006 e-mail chain indicates that then-FBI Assistant Director for Counterterrorism Joseph Billy signed the blanket national security letter. But when FBI lawyers raised concerns about it, he wrote back that he did not remember signing. "I have no recollection of signing anything blanket. NSLs are individual as far as I always knew," Billy wrote Caproni on Nov. 7, 2006. Billy did not immediately respond to a message left at his office on Monday. Kopistansky and Bald, reached by phone Friday, said they could not comment without FBI approval. Mefford did not return calls. In all, FBI managers signed 11 "blanket" national security letters addressing past searches, officials told The Post. Although concerns about their legality first arose in December 2004, exigent searches continued for two more years. Youssef's unit began limiting the number of exigent letters it signed between summer 2005 and spring 2006, seeking more assurances the requests could be covered by a national security letter, the memos show. Phone record searches covered by exigent letters ended in November 2006 as the Justice Department inspector general began investigating. Among those whose phone records were searched improperly were journalists for The Washington Post and the New York Times, according to interviews with government officials. The searches became public when Mueller, the FBI director, contacted top editors at the two newspapers in August 2008 and apologized for the breach of reporters' phone records. The reporters were Ellen Nakashima of The Post, who had been based in Jakarta, Indonesia, and Raymond Bonner and Jane Perlez of the Times, who had also been working in Jakarta.

When asked by Amanpour if she was willing to be arrested, she answered, "Yes, the answer is yes." Moving on to speak about the possibility of an internal Israeli investigation into the Gaza operation, Livni stressed that the most important outcome of such a probe would be to "defend Israeli soldiers." Regardless of the finds of such an inquiry, she said, "the morality of Israeli soldiers is not in question." "I want them to be able to leave Israel and visit other parts of the world… like other soldiers who fight for the free world," she said. Referring specifically to the Goldstone Commission report, which accused both Israel and Hamas of war crimes and possible crimes against humanity during Cast Lead, Livni said, "I cannot accept any comparison between Israeli soldiers and these terrorists." When asked whether Israel should pursue negotiations with Hamas, Livni responded firmly in the negative, stressing, "Hamas does not represent Palestinians… Israel needs to relaunch negotiations with Fatah, the legitimate Palestinian government." She said that Hamas represents "extreme religious ideology." Israel needs to "act in a dual strategy," working against terror, and "continuing dialogue with the moderates," Livni said. The Kadima chair went on to talk about negotiations with the Palestinian Authority with which she was involved in 2008. "We built trust… they understood that the Israeli government, at least the former Israeli government, wants peace," she quipped. It is the latest case in which high-profile Israeli politicians or army officers have pulled out of visits to Britain for fear of arrest over war crimes allegations under laws of universal jurisdiction. Israeli leaders have grown increasingly frustrated about the threat of legal action against individuals and are pressing the British government to change the law. Baroness Scotland, the attorney general, was in Israel today and due to meet with the Israeli justice minister, Yaakov Neeman, and deputy foreign minister, Danny Ayalon, to talk about the issue. A group of officers, reportedly from the rank of major up to colonel, were invited by the British army for a meeting on military co-operation but cancelled last week, the Guardian has learned. According to the Israeli paper Yedioth Ahronoth, Israeli officials feared possible arrest warrants and contacted British authorities to demand a guarantee that the officers would not be arrested. Last week, British officials, reportedly, said they could offer no such guarantee and the Israeli military promptly cancelled the visit. The Israel Defence Force declined to comment. Three weeks ago a British court issued an arrest warrant for Tzipi Livni, the former Israeli foreign minister, at the request of lawyers acting for Palestinian victims of Israel's war in Gaza. The warrant was withdrawn when it became clear Livni was not in the country but it provoked a storm of protest in Israel. Ayalon said the issue was damaging Israel's relations with Britain. "The risk to senior Israeli figures does concrete and immediate damage to bilateral relations," he told Yedioth Ahronoth. "Organisations that are hostile to Israel try to exploit the legal channels and legal tools to threaten the Israeli and British decision-makers, including the authorities of the attorney general herself, and to thereby create political facts that should be determined around the diplomatic negotiating table," he added. He said he would raise the issue in his meeting with Baroness Scotland. After the Livni arrest warrant there were discussions in Britain about changing the legal process so that the attorney general would first approve warrants before suspected war criminals could be arrested. The "safeguards" were to apply to all visiting foreign leaders, not just Israelis, but provoked outrage from lawyers. In October, Moshe Ya'alon, a former general and current cabinet minister, turned down an invitation to visit London for fear of arrest over an Israeli air strike in Gaza dating back to 2002. A week earlier lawyers tried to secure an arrest warrant against Ehud Barak, Israel's defence minister, while he was visiting Britain but it did not succeed since as a serving minister he still has diplomatic immunity. The gorillas at San Francisco Zoo were observed over a period of five years playing with a variety of equipment. The study found that gorillas like to keep games going and even give younger apes a fair chance to play. The psychologists said the research would help trace the evolutionary origins of how humans understand each other. Dr Joanne Tanner and Professor Richard Byrne watched gorillas play games to learn more about how apes are able to take account of each other's aims and abilities. Gorilla games The playtime involved balls, bags and bits of leather. Professor Byrne said: "Just like we would, the gorillas used gestures and displays of the object to keep the action going, and if the game slowed down or stopped a gorilla would use varied tactics to get it going again. "The players were also considerate of other's abilities. Gorillas definitely enjoy the same kind of sporting competition we do Dr Joanne Tanner University of St Andrews "An older and more skilled gorilla seeming to realise that if it used all of its potential, the younger one wouldn't be able to compete, so the older gorilla would slow down the pace." The scientists said this kind of shared activity and joint attention with another person begins around nine months of age in humans. Although this process has been suggested to be unique to humans, there have been some previous signs that our closest relatives among the African great apes, might also show similar abilities. As a result of the new study, the scientists can map the evolution of this process back to the time that humans shared ancestry with gorillas, more than six million years ago. Dr Tanner said: "Though the age at which gorilla games begin may be later in gorillas than in humans, and may depend on the challenges and artefacts available in a particular group's habitat, gorillas definitely enjoy the same kind of sporting competition we do." The research has been published by the journal Animal Cognition.

A new Wings from Emerging Earth AngelsWe are in interesting times indeed. And even though the energies seem to continually go this way and that way, there is a distinct pattern and purpose none-the-less, as this purpose navigates through the waters of the power of our creative thoughts. Right now, we are teetering…teetering on the brink of what the new world, new reality, or rather what Earth Two will look like, and the Haiti earthquake has assisted this planet in more ways than we could ever have imagined. From the onset of the earthquake in Haiti until it completed its core purpose (but there will still be more beautiful tendrils to come) on January 22, the energies were crying “distress!” or “SOS!,” or “911!” , or “I need help right now!” or even simply “I feel empty and drained” and “where am I anyway?” These energies were felt by all of us, no matter if we were aware of the situation in Haiti or not. Many souls were sending out a distress signal because of the insecurity they were feeling. And this insecurity could feel downright uncomfortable, unstable, and for many, excruciatingly fearful with a powerless slant as we may not have been sure how and where to move forward or what to hold onto. Add to this the lower level interpretations of the Haiti earthquake, and it is no wonder that many souls were experiencing a new insecurity, instability, and exhaustion from all the surrounding energies. This is an unprecedented time for us for several reasons, of which I will describe below. It is also a very precarious one, as things are indeed still a bit unstable now, even though we are making great progress in embracing the new shifts and allowing them to set the tone for our very new reality. We could still very well go into a time of a new unpleasant and dark reality if we are not careful, and if we are not mindful of what is now occurring. Even so, I personally trust that things will unfold quite nicely if we remember who we are and remain at the helm as the powerful creators that we were intended to be, as we turn the tide from the old reality experience to the new. So then, for the past week or two, there was nothing to hold onto, because we had not yet created it. We have completed step one, which brought in a wonderful energy that filled us up, weaving in and out within us, as it served to ground us to the new Earth. After this, we may have felt empty and drained, because we were readying for step two, as we are done with step one, and the energies we most recently experienced had departed for awhile. The Haiti earthquake arrived at a pivotal time, with the sole purpose of opening the hearts of the planet, and of setting a new tone of security, as it rocked the planet to its core in an attempt to jump start a very new way of being….and it has succeeded in every way and then some. Creating the new reality, or Earth Two, is very different than what we had experienced so far with Phase One of ascension. We no longer have the lower rungs beneath our feet that we had in Phase One of the ascension process. We no longer have others to fill the slots below us as we thought we would, because of the separation of the worlds which occurred in September of 2009 (hoping this is all making sense…there will be a synopsis at the end of this WINGS post that summarizes things for easier absorption!). This is then, a very different process. We are literally starting from scratch. Thus, all the seeming emptiness of late, as we grasp the thin air and attempt to mold it into a new reality of our making. But we must know that we are getting a tremendous amount of help simply from the new plan we created at our soul levels, and that what is very different this time, is that the plan is working now in all ways so far. The more we choose to see and embrace that this is occurring, the more we will feel a new sense of security and feel that something new and different is most certainly going on. This alone will serve to support our new growth, as these experiences will expand piece by piece, and moment by moment. Yes, we have completed the first step of creating the new Earth… which involved grounding and creating the first floor of the new reality. Like new seeds just planted, we have oh so slowly begun to sprout our own magnificent blossoms and new wings of energy, and thus, will grow into the new world like new budding babies. The next step, or step two, involves aligning with the energies of the new beginnings, or rather our very new endeavors or new spaces in the new world (you do not have to have a new endeavor if you do not choose to, but you will have a new space relating to who you are). So although the celestial events that occurred on January 15th gave us this new start, it is still up to us to hold that new energy blueprint up and bring it into form. Immediately after we experienced this new energy of the 15th, the energies dropped down once again, as too many souls were still tapping into Earth One, or the old world reality of control, oppression and loss of freedom. In addition, when a new blueprint arrives, we always need to align with it in all ways. So then, we may experience fear and darkness in regard to what we will now be offering, or how we will fit into the new reality. We next went through the process of releasing anything that may have held us back from completing our next soul purpose or soul slot in the new world. This can cause depression and anxiety, and certainly some fear as our new reality and new experiences are all very new….but so much better than we have ever known! We may not be used to living in a beautiful new world, so this can take some getting used to. We experienced darkness during the grounding phase of step one, and eventually came out of it feeling great, and this next step will be no different. The ascension process always creates a pattern of darkness and anxiety immediately after the good feelings that a new blueprint originally creates, and then we always move through it and onto the next phase. So then, there is nothing unusual here. And all during this time, and with each new shift, a tremendous amount of crown chakra energy has been arriving for us as well. Earth Two, or our new reality began as an overlay or parallel reality to Earth One, or the earth we left behind. We had to start somewhere, and holding a fair amount of the old reality in our consciousness is only natural. We are still human beings and we need something to connect to. After we finished with step one which grounded everything, we were then left empty again, and it was very easy to tap back into the illusion of the old world, as there was nothing here yet to sustain us (remember, there will be a summary of easy to digest points at the end of this post!…smile) The response to the Haiti earthquake and some other things that are changing within our old systems, are showing us that Earth One, or the old reality, is indeed slowly morphing into our newly inhabited Earth Two. These changes will slowly begin to adjust the old illusions, or basically change the old reality that we may still be holding in our consciousness and keeping alive. As of today, we have created enough of the new reality to hold us until the end of February, 2010. After that, everything drastically drops. We are literally creating one inch at a time, and as always, it is up to each and every one of us, what we choose to create. In some respects, we are in dire times right now, as we precariously teeter on the brink of what we may choose to create. We really need to be mindful of what we are holding in our consciousness, as it will serve to create our very new grid. But again, know as well, that the old reality consciousness that we are still holding is slowly and surely beginning to change. If we continue to hold onto the illusion of the old reality, or the “same old, same old,” and focus on it, then this is what we will continue to create. Believing anything to be true and holding up that illusion, will continue to make it real. It will give it life and feed it. So along with the Haiti earthquake serving to open the heart of the planet, it also showed us that help, support, caring, unity, trust, and making a difference are now some of the nuts and bolts of the new reality if we choose to tap into this massive new shift that has just occurred for us. These new nuts and bolts will serve as the mainstay or in other words, add to our very new foundation as well. What we need to do now, in order that we enter March in a relatively seamless way with no “drop,” is to keep our minds focused on what we desire for ourselves and for the planet, and on what we want our own individual lives and realities to look like. If enough of us continue to do this, we will create our own reality or new experience, and if we can manage to hold that vision for long enough, then we will eventually connect to others who fit in with our reality through the natural law of attraction. This is what the process of creating Earth Two is all about. We can begin by holding our own special vision of our desired reality in our minds upon waking each morning and going to sleep each night. And of course, we can always keep it, feel it, and hold it all day long as well. We need to declare with certainty and conviction what it is that we desire. We need to know that we can create with certainly and conviction, with no trepidation. The more we do this, the greater chance we have of creating it, and in these new and higher vibrations, we are creating very easily now. Eventually, our individual visions will connect to each other through the natural law of attraction, and a new grid will form. When a new vision is embraced and sustained within the consciousness of enough souls, then it becomes a new reality and every soul can then tap into it, see it, and navigate and live within it. Thus, it strengthens over time and will sustain itself. The new gatherings, or “soul celebrations” I will be offering this year, will serve to identify and anchor within each attendee, their new soul imprints, and then connect these imprints to other souls, thus assisting with the creation of the new grid (new e-book for navigating and experiencing these very new waters is in the making as well!). As we learn to sustain our vibrations within the new and higher vibrating energies, we will eventually create a self-sustaining higher vibrating reality and our visions and reality of unending miracles will become the norm. These are exciting times indeed! In a strange way, the Haiti earthquake has allowed us to see and feel that all is well…that different outcomes are possible now….that this planet really and truly does care…that this planet has a heart that is now very open once again…and that unity and love have been rekindled and revived as the air that the new reality will breathe. Each and every soul who was involved with this massive planetary shift can now be held in our own hearts with great reverence as the earth angels that gave of themselves to assist with our very new reality and new beginning. Dolphins demonstrate skills and awareness previously thought to be present only in humans. New MRI scans show that dolphin brains are four to five times larger for their body size when compared to another animal of similar size, according to Lori Marino, a senior lecturer in neuroscience and behavioral biology at Emory University, and one of the world's leading dolphin experts. Humans also possess an impressive brain-to-body ratio. "If we use relative brain size as a metric of 'intelligence' then one would have to conclude that dolphins are second in intelligence to modern humans," said Marino, who performed several MRI scans on dolphin brains. Marino will be presenting her findings at next month's American Association for the Advancement of Science meeting. "Size isn't everything," she admitted, but she says at least two other lines of evidence support her claims about dolphin intelligence. First, various features of the dolphin neocortex -- the part of the brain involved in higher-order thinking and processing of emotional information -- are "particularly expanded" in dolphins. Second, behavioral studies conducted by Marino and other experts demonstrate that dolphins exhibit human-like skills. These include mirror self-recognition, cultural learning, comprehension of symbol-based communication systems, and an understanding of abstract concepts. Marino believes these findings suggest that marine park shows, "dolphin-assisted therapy" facilities and other forms of captivity "are potentially psychologically harmful to dolphins and present a misinformed picture of their natural intellectual capacities." "This point is based on the simple proposition that the more aware an individual is of one's present and future circumstances, the more intensely one may feel the difference between a pleasant and unpleasant situation, or the more one can think about, and thus experience, negative feelings and ruminate about the negative consequences of one's circumstances," said Marino. "If this proposition is not true," she added, "then there is no basis for assuming humans suffer more than any other given animal." She pointed out that during dolphin drives, when the animals are herded together by boats, some dolphins become so panicked that they die of heart attacks. Others die from exhaustion attempting to flee, while still others become entangled in nets and are killed or injured. The dolphins that do survive are hoisted from the water, often by their tail flukes, and transported to the human-run parks and other facilities. "The scientific evidence on dolphin sensitivities reveals that they are vulnerable to trauma and suffering when forced to live in the confined context of marine parks," Marino said. Gay Bradshaw, director of The Kerulos Center, which provides sanctuary and support for animals suffering from human-caused trauma, agrees with Marino's determinations, saying, "What Dr. Marino states is congruent with theory and data." In its extreme variety, people wander the lanes of the Old City believing they are biblical characters; John the Baptist, say, or a brawny Samson, sprung back to life. Archaeologists in the Holy Land like to joke that their profession is vulnerable to a milder form of the syndrome. When scientists find a cracked, oversize skull in the Valley of Elah, it can be hard to resist the thought that it might have belonged to Goliath, or to imagine, while excavating the cellars of a Byzantine church, that the discovery of a few wooden splinters might be part of the cross on which Christ died. This milder malady is nothing new. In the mid-19th century, British explorers who came to Jerusalem with a shovel in one hand and a Bible in the other used the holy book as a sort of treasure map in the search for proof of Christianity's origins. (See a video of archaeology digging up controversy in Jerusalem.)Now an extreme case of the willful jumbling of science and faith is threatening Jerusalem's precarious spiritual balance. It could not come at a worse time: Israeli-Arab peace talks have stalled; Israel has a hawkish government disinclined to compromise; and radical Islamist group Hamas remains powerful among Palestinians. Any tilt in Jerusalem's religious equilibrium could create a wave of unrest spreading far beyond the city's ramparts. Eric Meyers, who teaches Jewish studies and archaeology at Duke University, says: "Right now, Jerusalem is a tinderbox. " The story begins with a right-wing Jewish settler organization called Elad, but also known as the Ir David Foundation, which for the past four years has exerted control over most of the holy city's excavations. Led by David Be'eri, an ex-Israeli commando who used to disguise himself as an Arab for undercover missions in the Palestinian territories, Elad now has the backing of the Israeli Prime Minister's office, the municipality, and the vaunted Israel Antiquities Authority (IAA), which monitors all archaeological work in the country and which Elad helps finance. Elad's own funding comes through unnamed private donors. (Israeli newspapers have reported that a few Russian-Jewish oligarchs, including Chelsea Football Club owner Roman Abramovich, attended a 2005 Elad fundraiser.) The organization's aim is best expressed in a religious website's 2007 interview with development director Doron Speilman. He gestures toward Silwan, an Arab neighborhood that spills down from the Mount of Olives, and says: "Our goal is to turn all this land you see behind you into Jewish hands." (See pictures of 60 years of Israel.)Elad's activities, in the views of its opponents, amounts to turning over Jerusalem's archaeology to extremist Jewish settlers. That has alarmed many Israeli and international scholars, Palestinian officials, and human-rights advocates. On a political level, it complicates efforts by the White House to enable both Palestinians and Israelis to share Jerusalem as their respective capitals, a key demand of the Palestinians. For scholars, it sparks concerns about whether Elad can be independent and objective in its work. And for Jerusalemites it raises a fundamental question: What matters more, the stones and bones of antiquity, or the lives of the people who live on top of all that history? Digging In to Push Out
Because it involves burrowing near the geographic core of three faiths — Christianity, Islam and Judaism — archaeology in Jerusalem has always been fraught. All three religions believe that it was here, on a stony hill, under roiling clouds speared by light, that God stopped Abraham from sacrificing his son. Christians also believe that Jesus walked, taught and was crucified in Jerusalem, and that he rose from the dead there. Muslims say that in the early days of Islam, Prophet Muhammad prayed first in the direction of Jerusalem before turning to Mecca, and that he was once transported by a flying horse to Jerusalem where he ascended to heaven. The city is embedded in the psyche of every Christian, Jew and Muslim. Elad's opponents accuse it of using archaeology as a means to expand Jewish settlements in Arab East Jerusalem. That would make it virtually impossible for the Palestinians to turn their section of the city into a future capital. According to Duke University's Meyers, Elad is "misusing archaeology as a tool of dispossession." Putting an ideologically motivated settler group in charge of excavations, says Daniel Seidemann, a lawyer from Ir-Amim,
a Jerusalem-based civil rights organization, is like "outsourcing the fire department to a pyromaniac." (Elad founder Be'eri did not respond to repeated interview requests from TIME for this article.) The flash point in the dispute is Silwan, an Arab village now listed in Israeli guidebooks as the City of David. It lies on the steep hillside just below the Old City's ancient, gleaming stones, facing towards the Dead Sea. Most of Silwan's Arab residents arrived in the 1930s, building homes that cling to the sides of the valley. Arab boys still canter on horses along the far hills. Some say that Job lived in Silwan, and that today's residents have inherited his ceaseless woes. According to Elad's Spielman, Be'eri was doing undercover work for the Israeli military in the mid-1980s in Silwan when a friendly Arab pointed out some ruins buried under a pile of garbage. "We know this is yours, we know this is your archaeology," the commando reported the Arab telling him. (See a video of the Pope visiting the Holy Land.)The villager had a point. In the mid-19th century, British explorer Charles Warren, while searching for the legendary treasures of King Solomon, uncovered a shaft leading down to an underground stream. He hypothesized that this was the water source for the city founded in 1000 B.C. by the Jewish King David. This underground stream, which surfaces in the Pool of Siloam about 500 ft. (150 m) below the ancient city walls, was Jerusalem's only source of water, so it made sense to Be'eri, and to many archaeologists, that David would have built his citadel over the stream or nearby. Inspired, in part, by Warren's claims, the multimillionaire and philanthropist Baron Edmond James de Rothschild* in the early 20th century bought several acres of land in Silwan. For Rothschild,* Be'eri and a succession of 20th century archaeologists the lure was a powerful one: evidence of David's reign would be proof that a major Old Testament protagonist was a true historical figure, and not mere legend. Politically, the discovery of David's citadel would strengthen Jewish claims to a contested part of Jerusalem beyond its pre-1967 borders. Late on a chilly October evening in 1991, Jewish settlers commandeered 11 buildings in Silwan and dug in. The case went to Israel's Supreme Court and Ariel Sharon, then Construction Minister (and later Prime Minister), rallied to the settlers' defense, arguing that "it is the policy of the government of Israel to encourage Jewish residence in Jerusalem." The settlers were allowed to stay, and Elad began building its presence in Silwan. The Israeli government turned over its property to the settlers, and Elad bought up Arab homes through intermediaries. Today, more than 500 settlers, along with Uzi-toting security guards, live among Silwan's 14,000 Arabs. Elad's archaeological expansion continues, with 88 Arab homes marked for demolition to build an "archaeological park." The group also has plans for a parking lot, a synagogue, 11 new houses for settlers and a cable car to the Mount of Olives, where many believe the Messiah will arrive. With official Israeli backing, Elad has ambitions beyond Silwan. Lawyer Seidemann claims that since mid-2008, the Israeli government has accelerated a policy of "aggressively and covertly expanding and consolidating control over Silwan and the historic basin surrounding the Old City." The plan, he says, involves "the take-over of the public domain and Palestinian private property ... accelerated planning and approval of projects, and the establishment of a network of a series of parks and sites steeped in and serving up exclusionary, fundamentalist settler ideology." In its essence, the plan places a large area of Arab Jerusalem under Jewish control. "It risks transforming a manageable, soluble political conflict into an intractable religious war," he warns. For their part, many religious Israelis defend Elad's efforts to unearth their buried heritage. "For us, and for anyone who believes in the Bible, this is the real history," says Urieh King, a Jewish settler and activist. "These are our roots." Welcome to Bible Land
For now, Elad's centerpiece is the City of David, a cross between an archaeological site and a Jewish theme park that draws more than 400,000 tourists a year. Visitors are led through a honeycomb of caverns and excavations propped up by scaffolding. Then they wade through an underground canal that emerges into sunlight at the Siloam pool, where Christ is said to have cured the blind. Nearly half the visitors are Israeli army conscripts and schoolkids who hear lyrical description from Elad's guides about how the site is the very foundation of Jewish culture and history. "In fact," Elad's development director Speilman boasted to Nachum News, an Israeli website, "60% of the Bible was written on this little hill." (See pictures of John 3:16 in pop culture.)But many experts find Elad's archaeological claims dubious. Israel Finklestein, an archaeologist from Tel Aviv University says that while there may be ruins on the Elad site dating back to the 9th century B.C., "there's not a single piece of evidence about David's palace. These people are mixing faith with science." Yoni Mizrahi, an independent archaeologist formerly with the IAA, concurs: "You'd think from Elad's guides that they'd excavated a sign saying WELCOME TO DAVID'S PALACE. Their attitude seems to be that if you believe in the Bible, you don't need proof." Raphael Greenberg, lecturer at Tel Aviv University, says Elad ignores key archaeological practices. "You're supposed to dig for six weeks and then report on what you find. In the City of David, they've been digging nonstop for two years without a satisfactory report," Greenberg says. He accuses Elad of using archaeology as a "crowbar" to "throw out the Palestinians living in Silwan and turn it into a Jewish place." Elad's chief archaeologist, Eilat Mazar, says that "our working theory is that David's palace is down there." Mazar, an associate of the right-wing Shalem think tank, claims that workers have uncovered pottery shards from the 11th century B.C. and Phoenician motifs. "We know the Phoenicians built a palace for David," she says. (See pictures of a divided Jerusalem.)All excavations in Jerusalem are overseen by the IAA, and its director, ex-General Shuka Dorfman explained to TIME that while Elad manages and funds more than a dozen digs around Jerusalem, an IAA archaeologist is always on-site to analyze findings. Dorfman concedes that the settler organization's interpretation of its findings in Silwan "is different from ours." He adds: "They emphasize only the Jewish heritage." Sometimes, according to archaeologist Mizrahi, the Elad-sponsored digs ignore other strata of Jerusalem's multi-cultural history. "They're only focusing on one tradition — the Jewish one," he says. He has a point. In 2008, it emerged that while Elad-sponsored archaeologists were digging near the Western Wall, they found and removed dozens of skeletons from a Muslim graveyard without properly documenting the find, according to Haaretz, an Israeli daily. The skeletons have since gone missing. After a barrage of complaints against the IAA by academics, Palestinians and civil rights groups, the agency's chairman, Professor Benjamin Kedar, conceded in a statement that the IAA is "aware that Elad — an association with a pronounced ideological agenda — has presented the history of the City of David in a biased manner." So far, though, the cash-strapped IAA says it has no plans to review its ties with the settlers, who are its main funders. A Fragile Peace
Naturally, archaeology's Jerusalem Syndrome is not limited to a single religion. Many Muslim scholars refuse to believe that a Jewish temple ever existed beneath the Haram al-Sharif, or Temple Mount, even though thousands of Jews flock every day to pray at the Western Wall. The Waqf — Jerusalem's Islamic authority — made Jews furious in 1999 when they built an underground mosque inside the Haram al-Sharif and, according to irate Israeli scholars, gouged out "several hundred" trucks' worth of debris, destroying evidence that might shed light on Judaism's holiest site. "This was politically motivated," fumes archaeologist Gabriel Barkay, who leads a team of volunteers that has spent years sifting through large mounds of material from the sacred precinct that was rescued from a city dump. "In places where you should have used a toothbrush, they used a bulldozer." But few projects threaten Jerusalem's peace as much as that at Silwan. In 2007, Arabs there began hearing strange banging under their homes "like an earthquake," one resident recalls. Soon, cracks opened up in the floors and snaked up the walls. The Silwan residents protested against the settlers' tunneling, without the necessary permits or safeguards. "All that happened was that the police arrested us," complains Jawan Siyam, a Silwan local. Elad was opening up a 650 yd.-long (600 m) drainage tunnel, running under Arab homes, that Elad claims dates back 2,000 years, and may have been used by Jewish rebels to escape a Roman siege. Civil rights groups last year got the Supreme Court to suspend the diggings. In its ruling, the court said that the local authorities had failed to obtain consent from the owners of the houses marked for demolition. Could Elad's work upset Jerusalem's fragile balance between Islam and Judaism? Palestinian historian and Waqf religious affairs archaeologist Yousef Natsheh believes so. He points out that one of the main triggers of the 2000 Palestinian uprising — which led to the deaths of more than 5,500 Palestinians and 1,000 Israelis — was a visit to the Haram al-Sharif precinct by Sharon, then Israel's opposition leader, along with a phalanx of armed police. "The situation now is very, very tense," he warns. It shouldn't be. Jerusalem is one of the world's richest archaeological sites. In its 6,000-year history, the city has changed hands more than 120 times. It has been ruled — and this is an incomplete list — by Jebusites, Israelites, Romans, Persians, Greeks, crusaders, Mamelukes, Ottomans, British, Jordanians and modern Israelis. "We Jews are not alone here," says archaeologist Finklestein. Would that all who treasure the holy city — of any religion and none — could agree on sharing its sacred past.

New Wings reportThe New Unity Begins January 31, 2010 Much has changed since the last WINGS post, as we have made great progress. Even though things may seem scary, uncomfortable, and at best, seem that the world is unraveling, I can assure you that things are right on track, as the divine plan continues to unfold. We are “re-setting” and “re-calibrating”…starting over once again as we begin the massive re-structuring of a very new Planet Earth. In this way, the old must fall, and falling it is. As human beings, many of us are really a microcosm of the earth. So then, whatever happens with her, we will feel as if it is happening within us too. During recent times, we may feel that we, ourselves, are coming unraveled and falling apart, but we are simply a mirror for our beautiful planet, as we embody so much of her within ourselves. The earth is now in the process of re-aligning with the higher realms, or new and higher vibrating ways of living and being. Part of the new ways of being involve coming together in unity. So then, the phase we have most recently begun, involves a pulling apart of energies as they begin to re-group. Like a massive cell division, we are leaving some individuals and arenas, as we connect to our true and rightful arenas. We are beginning now, and will continue with this process, of coming together in like-minded pods, as we form small groups of individuals who resonate with each other, and who will in time, begin creating with each other, and will as well, support each other in sustaining themselves. This is the way it was intended. What is occurring now, is that this process is indeed beginning as it should be. Things are falling away, as this process will encourage many of us to unite together, leaving the old reality of the individual far behind. This will all happen very naturally for us, but we must also be willing to jump in and take our next steps of action as well. I have been writing of this process for many years, and it is in my very first book, Remembering Your Soul Purpose, as well. I tell you this as an example that this time was destined to arrive. There is nothing wrong here. This is a very exciting time! When Barak Obama was elected the president of the US, his soul plan was to keep things as intact as possible, in order that the re-structuring would not cause a substantial amount of trauma for the planet. The soul print of the US is to serve as a vibration that reverberates out and affects the rest of the globe in its wake (and not in the best way at times!). Barak Obama had a soul responsibility to keep things as steady as possible while these changes were taking place. So no matter how strange it looked in regard to what he was doing, at the higher levels, he was following his plan. As we know, the larger plan (and he was a part of it) did not take hold as was anticipated. Thus, the separation of the worlds. So now, with the creation of Earth Two, the very new structures are coming into play, as this is part of how Earth Two needs to unfold and be created. Thus, 2010 will indeed be a year of manifestations, creativity, and self-expression, as we will be embodying all of these things as we come together to create the new world. Earth changes and natural disasters will also occur, and these shifts on the earth will also serve to bring us together in unity. The Haiti earthquake has already served this purpose and done so magnificently. The love and reverence extended to the souls who agreed to participate in this process goes beyond words. Almost daily now, we are receiving massive amounts of energy coming through our crown chakras. This energy is serving to sustain these new and higher ways of living and being. This energy is greatly assisting in holding the space while the planet adjusts, along with all of her inhabitants. These energies continue to arrive in stop-starts. In this way, we may feel high and magnificent one day, and deeply down the next. The contrast between the new reality energy and the massive let down, lull, or absence of any energy is quite extreme. I was recently involved with a large printing project. The pages would print for awhile, and then suddenly stop. Several times, I had to re-set my printer, and then it would begin to print again. I can be watching a dvd or satellite television, and the same thing happens. The story stops mid-stream, in a freeze frame, and then suddenly starts up once again. These are all indicators that the energies are indeed arriving, if only piece by piece, as we slowly but surely integrate them. We can feel very connected and clear one day, and then totally lost the next. We can remember and connect to our next steps with complete certainty, and then fall off the planet the next day. We may find it near impossible to remember what we “used to” know as a higher level being. These are indicators of the new reality energy coming in bit by bit. Remember, we are starting over. But what is more recently occurring, is that the dots are starting connect very securely. The days of great highs and connections are getting longer and there are more of them. The lows are getting shorter and there are fewer of them. We can wake up one morning, and things suddenly feel different (Monday, the 25th was one of these days). We had arrived somewhere new that day, because enough of the new energies had been integrated. This created a new shelf or new space for us to walk into. On other days, like today (Sunday the 31st), higher energies are coming through and our hearts may be racing. So many of the dots or higher energies within us, have connected, that we are now in a new space that sustains the new energies much more easily. At the same time, we may have felt like sleeping a lot of late, or been unusually tired. We are integrating rapidly now, as we create the new spaces and new pieces of our very new reality. Our creating abilities are profound now. This is why focusing on and visualizing what we truly desire is so vitally important, as it serves to keep our spirits up, as well as serving to form the new reality in all ways, and keep that is place as well. Our new connections will be the theme now for quite awhile. Not only will these connections serve to create the new world, but they will also serve in sustaining us, keeping the energies high and balanced through the connection of our own personal energies, as well as giving us the emotional support that we will need in times to come. We have come together in times past, through web sites and the like, but the new connections will be different in that we will unite with our soul teams and those with whom we resonate the most. For me, now and in times past, I have never been affiliated with any web sites or groups outside of my very own web site, as I have always stayed in my own backyard in order to keep the energies as pure, clear, and pristine as possible, and quite honestly, know very little of what is occurring outside of my own web site (and no, I do not have a Face Book group). I would like to take this time to say a big thank you to all of you who have posted the WINGS and What’s Up On Planet Earth? messages on your sites, and with your groups, whomever and wherever you are, in integrity and in alignment with the universal copyright notices at the bottom of this page. Your dedicated service to the planet, while connecting us all together, along with bringing your own special energies to your endeavors, have assisted so many in the challenging first phase of the ascension process. Thank you so much for assisting me as well. Although I do not know most of you personally, I cannot thank you enough. So please, allow me to thank you now. A newly added Emerging Earth Angels role in times to come, will be in bringing us together through “soul celebrations” gatherings in physical form, along with communicating and supporting the new structure and grid, and connecting us more fully to our true and authentic selves. I greatly look forward to it, along with so many of your new offerings as well. So as the dots begin connecting more and more, we will begin to feel a new a different security, as it will be the security of the very new reality.
